GENERAL TERMS AND CONDITIONS
Travel services contract
Last updated: October 16, 2026
These terms retain the useful structure of the 2018 document while updating its references, responsibilities and information mechanisms for the current regulatory framework.
1 Service and price information
Descriptions, itineraries and prices provided before confirmation are for information purposes and may change due to availability, costs, taxes, charges or exchange rates. Before a contract is entered into, Viajes Alkimista will disclose the total price, its relevant components, payment terms and any applicable restrictions. Advertising, the offer, specific terms and the documentation supplied form part of the contract.
2 Requests, confirmation and payments
Payments received before final confirmation may be applied as a reservation payment. Confirmation will be evidenced by the documentation issued for the transaction, such as an invoice, receipt, ticket, voucher or service order. All services must be paid within the deadlines communicated for each contract. Failure to pay may trigger the consequences previously disclosed, including penalties actually applicable from providers. Airfares are also governed by the conditions disclosed by the carrier and the selected fare.
3 Included services
Only services expressly stated in the quotation, itinerary, voucher or service order are included. Hotel categories are those recognised at the destination. A triple room may consist of a double room with an extra bed where this is what the establishment offers. Check-in and check-out times and the calculation of nights depend on the accommodation policy communicated.
4 Excluded services
Personal expenses, drinks not specified, laundry, tips, fees, taxes, visas, optional excursions, excess baggage, insurance or assistance, transfers and other items not expressly listed as included are excluded. Additional expenses arising from external events will be allocated according to applicable law, the provider's terms and the responsibility attributable in each case.
5 Health and immigration documentation
Viajes Alkimista will provide available, relevant information on immigration, customs and health requirements. Passengers must check sufficiently in advance that their personal documentation is valid, in good condition and suitable for their nationality, age, itinerary and stopovers. Requirements may change by decision of the authorities. When travelling with minors, the authorisations and documents required at the time of travel must be observed. Costs or responsibilities relating to documentation will be allocated according to the information supplied, each party's obligations and applicable regulations.
6 Cancellations, withdrawals and refunds
A passenger's cancellation will be considered received when communicated by a means that allows receipt to be evidenced. Penalties and refunds will depend on the specific terms disclosed and the charges actually applied by airlines, hotels, operators and other providers. Relevant cancellation terms will be communicated before payment. Viajes Alkimista will itemise non-refundable amounts and account for charges applied where appropriate. Once the trip has begun, services not used at the passenger's choice will be addressed according to the specific terms, the actual possibility of recovery from the provider and applicable regulations. Nothing in this clause limits mandatory consumer rights.
7 Assignment and passenger changes
The possibility of transferring a booking or replacing passengers depends on the terms of the carrier and other providers. Tickets issued in a named person's favour may be non-transferable. Changes may result in fare differences or expenses, which must be disclosed before acceptance.
8 Air transport
The ticket or electronic document evidences the contract between the passenger and the carrier, even when issued by an intermediary. Scheduled and non-scheduled air transport is governed by the Aeronautical Code, applicable international treaties, Decree 809/2024 and the carrier's valid regulations. In the event of delays, cancellations, denied boarding, changes or baggage incidents, passengers retain the rights and remedies provided under that framework. Viajes Alkimista will provide reasonable assistance where it was involved in arranging the service, without replacing the carrier's own obligations or excluding responsibilities legally attributable to it.
9 Non-scheduled transport and services with special conditions
Charter flights, allotments, groups and promotional fares may have more restrictive payment, change and cancellation terms. Their nature and consequences must be disclosed before contracting. Charges actually provided for by the supplier and accepted on an informed basis will apply, without affecting mandatory rights.
10 Liability and intermediation
Viajes Alkimista may act as an organiser, seller or intermediary depending on the transaction. Where a responsible operator is involved, its identity and address will be disclosed in the contractual documentation. The liability of Viajes Alkimista, providers and carriers will be determined according to the service undertaken, Law 24,240, the Civil and Commercial Code, specific regulations and the terms validly disclosed. Liability established by law is not excluded in advance. A party relying on an external cause, fortuitous event, force majeure or act of a third party must establish the conditions supporting that claim and act in good faith to mitigate consequences and offer reasonable alternatives where appropriate.
11 Operational changes
For technical, operational, safety or force majeure reasons, an itinerary may require adjustments before or during the trip. Changes will be communicated clearly and promptly. Where possible, equivalent services or alternatives will be offered. If a change is material, the options, refunds and responsibilities provided by applicable regulations and the specific terms will apply. Hotels may only be replaced by establishments of an equivalent or higher category, unless another solution is expressly accepted.
12 Conduct and continued participation
A person's participation may be discontinued where their conduct creates a serious, demonstrable risk to themselves, third parties or the normal provision of the service. The measure must be reasonable, non-discriminatory and compatible with the duty of safety. Financial consequences will be determined according to the circumstances and applicable regulations.
13 Accessibility, dietary needs and health
Before contracting, passengers must disclose accessibility, dietary or assistance needs that may affect the organisation of the service. Viajes Alkimista will consult providers about reasonable adjustments and communicate their availability, limitations and any costs. Sensitive information will be processed only to coordinate the service and in accordance with the Privacy Policy.
14 Weather and destination risks
Weather, health, political or natural events may affect a destination. Seasonal or risk information is indicative and must be checked against official sources before travel. The consequences of a disruption will be addressed according to the affected service, its cause, the terms disclosed and applicable regulations; travelling during a particular season does not imply a general waiver by the passenger.
15 Electronic contracting and acceptance
For distance contracts, Viajes Alkimista will make these terms, the specific terms and relevant documentation available before acceptance. Acceptance must be capable of being evidenced, and the passenger will receive a copy or confirmation on a durable medium. The right of withdrawal will be respected where legally applicable and subject to the applicable exceptions. No wording of acceptance reduces mandatory rights.
16 Information, assistance and complaints
Enquiries and complaints: accounts@viajesalkimista.com, WhatsApp +54 11 5032 2554, or Allende 4132, CABA (postal code 1419), Buenos Aires. Consumers may also contact the relevant public consumer protection authorities and systems.
17 Applicable regulations and contractual documents
The contract comprises these terms, the specific terms, the offer and advertising, the quotation, invoice, vouchers, tickets and other documentation supplied. It is governed by Law 24,240, the Argentine Civil and Commercial Code, Law 25,326 where data processing is involved, the Aeronautical Code and Decree 809/2024 for air transport, applicable treaties and other regulations in force. References in the 2018 text to Law 18,829, its Decree 2182/72 and Resolution 1532/98, which have been repealed or replaced, are no longer relied upon as a current legal basis. In case of doubt, the interpretation most favourable to the consumer will prevail.
